Disclaimers; Limitation of Liability

1. The subscriber shall not be entitled to any service unless he/she has paid in full

2. All information received via SMS Alerts is provided “as is” and “as available”, unless in conditions where there is a network failure or any other unforeseen circumstances within KK Security’s areas of operation.

3. KK Security and its subsidiaries, affiliates, partners, licensors and suppliers hereby expressly disclaim to the extent permitted by law any representations or warranties of any kind, express or implied, including warranties of merchantability, fitness for any particular purpose, non-infringement, or as to the operation of this service, the content.

4. Neither KK Security nor its subsidiaries, affiliates, partners, licensors and suppliers warrants or makes any representations that (A) this SMS Alert Service will meet your requirements, (B) this SMS Alert Service will be uninterrupted by any circumstances whatsoever beyond its control including but not limited to acts of war, civil commotion or strife, lockouts, stoppages or restraint of labour from whatever cause, whether partial or general, governmental interference or restrictions, fire, flood, acts of God, compliance with International, National or local regulations or any other regulations having force of law, weather conditions or failure of communications for any reason, timely, or error free, or (C) the results that shall be obtained from the use of this SMS Alert Service (including any information and materials on their Website) will be correct, complete, accurate, reliable, or otherwise meet your requirements.

5. KK Security and its subsidiaries, affiliates, partners, licensors and suppliers shall have no liability for interruptions or omissions in network or hosting services and do not warrant that this service or other electronic communications sent by KK Security are free from viruses or any other harmful elements.

6. Any content obtained through the use of this service is for your use and at your own discretion and risk. You will be solely responsible for any actions that you take resulting from the receipt of this information. KK Security shall not be liable for any damage, injury or loss in whatever way sustained by a subscriber in the absence of the SMS Alert services.

7. KK Security will not be responsible for any expenses related to additional services which the subscriber may require over and above what the subscriber initially contracts KK Security for and which service KK Security provides. KK Security shall not be bound by any variation, waiver or addition to these conditions except as agreed by KK and the subscriber. Such agreement shall be in writing and signed by both parties.

8. In no event shall KK Security or any of its subsidiaries, affiliates, partners, licensors or suppliers be liable for any direct, indirect, consequential, punitive, special or incidental or other damages resulting from, arising out of or in connection with the access, use of, or inability to access or use of this SMS Alert service, the content, even if KK Security has been advised of the possibility of such damages except to the extent such damages arise directly and solely from wilful misconduct or gross negligence on the part of KK Security.

9. Should any dispute or difference of any kind whatsoever arise between the parties herein, the matter in question shall be settled amicably by mutual discussion as a principle. However when such settlement cannot be reached, the matter shall be referred to the settlement by an arbitrator to be mutually agreed upon by the parties. In default of agreement an arbitrator shall be appointed by the Chairman for the time being of the Institute of Chartered Arbitrators (Kenya Chapter) in accordance with the Arbitration Act of 1995 or any statutory modification or re-enactment of it for the time being in force. The decision of such arbitrator shall be conclusive and binding on the parties herein.

10. This contract will be governed by the Kenyan Law.
